Slashdot: Judge Orders Deleted Emails Turned Over (Gmail)

I am no evil genius planning on taking over the world,
but I still am concerned about my privacy.

In previous threads backup policies are explained.
I remember that backups are kept on an online backup server for 1 week. No messages are kept on tape. Is this correct?

How does the fastmail-policy see this?
Which information does fastmail release to local gevernments?
Are there consequences of the servers residing in the States?
