comply to Home Land Security?

FM is owned by Australian company BUT since servers are

located in US if the policemen from Home Land Security

wants to read my email then the FM needs to comply with US

Law?


My guess is YES, FM will hand over all my email from girlfriends

to them.

Yes unhappysoul, but If Homeland security want access to your mail likely they will get it (regardless of where you live or host your email) International law applies in most countries and most countries co-operate (and have agreements) with the United States.

PS: Unless you are a threat to the security of the United States I very much doubt they will be at all interested in reading your mail.

There is more than one question here.

One, is FM obligated to abide by US law? Absolutely it is.

But the second question is even more important. Laws of the United States and the powers a department of the federal government claims are not necessarily in sync at all times. Abiding by the law is not the same as succumbing to every request from a police department.

Thirdly, there are ways for the government to see your email, however, the legality of the way such information is obtained can be and is regularly challenged in court, and if deemed to have been obtained illegally or in violation of the Constitution, they have to be thrown out.

What about other countries? what if the authorities in my country (Israel) obtain a court order (or whatever it's called) from an Israeli court that allows them to read my mail.

Most likely if you are a real criminal they can then enforce the court order through Interpol or through bilateral agreements with the US or whatever. Probably it would be a bit tougher for them to do it since it would have to be something that can be done under the laws of both countries and also something the countries have agreed to through either bilateral or international treaties, which would probably include much less than what a government can do to you within its own territory. I don't really know much about it, but I know that countries do cooperate on fighting crime, and usually limit their cooperation to harsh crimes. So if it's shoplifting you're suspected of (or spamming) then they probably would not chase you across the border. If it's dealing in drugs, pedophilia (or more recently online gambling) then they might cooperate. There was a somewhat related article today here (Hebrew) and here (unrelated, English, Slashdot).
