Commerical Emailing with Private WHOIS - Illegal?

I recently heard that if you have a Private WHOIS, it's illegal to send commercial email from that domain. From everything I'm reading it seems to be a grey area, but personally, I'm siding on the side that it's perfectly legal.

Can someone offer more clarification on this?

I've registered a few private domains and never seen any clause in the registrar's T&Cs prohibiting commercial email from those domains.
